The court, referring to previous cases, emphasized that such breaks should not be treated as interruptions. It held that Bukharia's regularization, considering his ad-hoc period, meant that his entire ad-hoc service should be counted for pension benefits.

And this is the part most people miss: the court's decision was based on the unamended Rule 15A, which was in effect when Bukharia retired. The 2020 amendment, which granted him 111 days of benefit, was not applied retrospectively.

So, the court quashed the impugned order and directed the state to count Bukharia's entire ad-hoc service towards his pension.
